1. Overview of the Perks Advantage Program

PharmaChoice Canada (the “Administrator,” “we,”, “us”, and “our”) is the owner and administrator of the Perks Advantage Program (the “Program”), which is run in accordance with the terms and conditions outlined in this document (the “Terms”) on behalf of all participating PharmaChoice Canada locations. Please check www.PerksAdvantage.ca  (the “Program Website”) to see if a particular location is a Participating Location. The list of Participating Locations is subject to periodic revision.

The Program has a loyalty rewards component that enables participants to accrue Perks Advantage Points (“Points”) and redeem digital coupons (“Coupons”) when making purchases at Participating Locations and to redeem those Points or Coupons for cash savings, all in accordance with these Terms. Participants who have received or been issued a PharmaChoice ID (as defined below) and who have finished the membership enrollment and registration process are eligible to participate in the loyalty rewards and digital coupon components.

You can access your Perks Advantage account and other upcoming online activities with the help of a PharmaChoice ID, which is a unique number. A PharmaChoice ID can be virtually assigned during the registration process and accessed via the Program website, or it can be displayed on an optional physical Program Card available at Participating Locations. 

2. Engagement in the Program

No initial purchase is necessary to join the Program (become a “Member”), and membership is free. If you are an individual consumer, a resident of Canada, and you are 14 years of age or older, you are eligible to join.

We have the right to ask for evidence of age if we have any cause to suspect that a Member is under the age of 14. In the absence of proof, all personal data pertaining to that person may be erased from our system, and that Member’s membership may be cancelled, with the immediate loss of all Points.

Simply complete the online registration process at the Program Website and adhere to the instructions to create and register an online Perks Advantage account in order to become a Member. Members can register online with a virtual PharmaChoice ID or choose to use a physical Program Card as their PharmaChoice ID by registering with a physical Program Card. You must finish the enrollment and registration process, provide accurate and complete information, and indicate your approval of these Terms in order to be considered a legitimate Member. Only a single Account is permitted per person.

The Administrator has the sole power to alter the Program’s participation procedures at any time.

3. How Perks Advantage Points are Earned & Digital Coupons are Redeemed

Earning Perks Advantage Points can be done in a number of ways:

Promotional Offers: On occasion, Members may receive Points for the purchase of specific products, for spending a specific amount, or for accruing a certain number of Points. You can benefit from these deals with your PharmaChoice ID without first clipping them to your online Account, including but not limited to those that are advertised in Participating Locations or through flyers. Some promotional offers may require the offer to be clipped to your online Account accessible via the Program Website in order to be earned or eligible for redemption. 

Purchases of Eligible Products at Participating Locations: One Point will be earned for every $10 spent on purchases of Eligible Products at Participating Locations. The purchase price of qualifying products, less any applicable discounts and taxes, as displayed on each purchase receipt, will be used to compute points. Products that are not eligible are listed in Section 5.

Personalized Offer: Offers that are specifically tailored to each Program Member may occasionally be sent to them by email, the Program Website, or other methods (“Personalized Offers”). To use Personalized Offers at Participating Locations, you may be required to clip the offer to your online Account. You can do this using the Program Website or any other method we may occasionally come up with. The Personalized Offers will not be enabled and you won’t get the rewards or discounts associated with them if you don’t clip them to your Account before your transaction is finalized by the cashier.

Prior to making a purchase, you must indicate your PharmaChoice ID or provide alternate method of proof of Membership in the Program (such as phone number or other method we may devise) to gain Points or redeem Coupons. If the original receipt and your PharmaChoice ID are provided within 30 days of the date of the initial qualified purchase, points may be granted retrospectively.

On occasion, additional incentives, prizes, or Points may be given for using your PharmaChoice ID or for being a Member through specific programs run by Participating Locations. Dollar off coupons, product offers, customised pricing, and services provided by Participating Locations are a few examples of additional rewards, awards, or advantages that may be provided. Some promotional offers might not be available at all Participating Locations and be restricted to program Members that identify a Participating Location as their “Home Store”. Should a Member change their Home Store location via the Program Website or any other method we devise previous offers may no longer be available to the Member. Alternatively, new offers may become visible that are associated with the newly selected Home Store. 

Any promotion or offer has a time limit and could have additional terms and conditions in addition to these Terms. Unless specifically indicated otherwise in the terms of the offer or promotion, each offer is only good once.

4. Rewards Points

By using your PharmaChoice ID at the point of sale in Participating Locations and following the instructions given by the cashier, the point-of-sale terminal, or other payment processing device, you can “redeem” your Points by using them to fully or partially pay for eligible products. The Points you earn can be redeemed for qualifying purchases (exclusions are listed in Section 5 below) or for any other uses that we may occasionally inform you of.

To redeem Points, you must be a member of the Program, have registered your PharmaChoice ID, or have contacted customer support in some other way. The Administrator will retain ownership of any Points accrued on a PharmaChoice ID until the enrollment and registration process has been finished.

A minimum of 15 Points, worth $5, must be redeemed at once during a qualifying transaction. In a single purchase, points can be redeemed in $5 increments up to a maximum of $215 (645 points) in a qualifying transaction. 

5. Restrictions on Eligible Purchases and Redemption

Taxes, tobacco products, codeine-containing products, lottery tickets, alcohol, bottle deposits, gift cards, prepaid phone cards, wireless or long-distance phone cards, event tickets, transit tickets and passes, post office transactions, stamps, passport photos, cash back, gifts with purchases, delivery fees, environmental levies, prescription medications, home health care services/rentals, and any other services or products we may specify from time to time or where prohibited by law are not eligible for the collection of Points.

A subsequent qualifying purchase is the only one for which you may use the points you earn after making a purchase.

6. Other Collecting and Redemption Regulations

Your Account balance will be decreased by the number of Points earned for any returned items. If a refund or correction is made to your account, the number of points associated with the refund or correction, as appropriate, will be added to or subtracted from your account balance.

We believe our records of the number of Points accrued, used, or taken away are accurate. Within 30 days of the transaction date, you must contact us with any questions you may have about the amount of Points in your Account and provide any supporting documentation. Requests for missing Points that are submitted more than 30 days after the transaction date will be deemed void.

The amount of Points that is shown on your receipt at a Participating Location, on the Program Website, in an email, or through any other means is merely for your information and might not accurately reflect your actual Points balance as per our data. We accept no obligation for any inaccuracies in the displayed Points balance to the extent allowed by law and to the extent that we are not accountable for those errors. We retain the right to immediately and without prior warning deduct the quantity of Points that were incorrectly given to your Account. Requests to redeem Points contributed inadvertently to an Account are not guaranteed to be honoured by us. If, in our reasonable view, the products purchased will be utilized for resale or commercial purpose, Points will not be given, and any Points awarded on such purchases will be lost. We retain the right to restrict the number of Points issued in connection with any offer or campaign to an amount appropriate for a household. The Points given as a consequence of such offer or promotion may be forfeited without prior notice if a Member received them for a transaction that exceeded what is considered reasonable for a household.

We disclaim all liability for any mistakes that might be made in the sending or loading of offers, including Personalized Offers, as well as for any delays in doing so. If an offer, including Personalized Offers, is sent or loaded incorrectly or takes longer than expected, we are not required to honour the request to collect or redeem the points that resulted from the error or delay.

Contact us immediately to have the redemption features of your Account disabled if your PharmaChoice ID is lost or stolen. We are not liable for any redemptions made on your Account, including any redemptions made before you disable redemption features on a lost or stolen PharmaChoice ID and any redemptions made as a consequence of unauthorized access to your Account. Please get in touch with our customer service department if your PharmaChoice ID is damaged, stolen, or lost (further information is provided in Section 10). To transfer the Points balance in your Account to your new Account, you must always get in touch with our customer care service and present the required identification.

Points are not redeemable for cash and have no monetary value. Points cannot be sold, traded, bartered, assigned, swapped, purchased, given as gifts, rented, or exchanged except as may occasionally be approved by the Administrator. Any points gained in this way are useless. The acquisition of Points does not grant the Member any vested rights, and neither the Administrator nor the Participating Locations can ensure that any reward, redemption level, rebate, or other benefit will always be available. Regarding the inclusion or removal of products for which Points may be accumulated and/or redeemed, the Administrator disclaims all responsibility.

You could be allowed to give your Points to another Member, subject to the Administrator’s sole discretion. A Member’s Account will be terminated and any Points in it forfeited upon the death of the Member. In the event of a divorce or the equitable division of marital property, points cannot be divided.

If a Member does not collect or redeem Points for 24 consecutive calendar months, that Member will be deemed inactive, and all accumulated Points will be lost. If a Member who is considered to be inactive contacts our customer support team, the Administrator reserves the right, in its sole discretion, to reinstate all or any of the Member’s Points (see Section 10 for more information).

7. Privacy

The Program Website provides access to the privacy policy (the “Privacy Policy”) for the Program. This privacy statement might change from time to time. You acknowledge that by accepting these Terms, you are also accepting the Privacy Policy’s terms, and that these terms may be updated from time to time.

The Program Website contains the Terms and the Privacy Policy.

8. Membership Termination and Program Cancellation

If in our opinion you have misused any Program privilege, disregarded these Terms, or made any misrepresentation to us or to any organization connected to or taking part in the Program, we have the right to suspend, cancel, or terminate your membership in the Program at any time. We may also terminate your membership if any of the following circumstances arise: (a) you pass away; (b) the Member becomes bankrupt or insolvent; (c) the Member initiates any bankruptcy or insolvency proceedings by or against the Member; or (d) the Administrator suspects the Member of engaging in fraudulent activity in connection with the Program. 

Your membership in the Program may be terminated at any time by giving written notification to the address listed below or by getting in touch with our customer support staff (see Section 10 for more information).

The Member’s Account will be immediately closed upon termination or cancellation of membership in the Program, and all Points accrued in such Account will be forfeited.

We reserve the right to cancel the Program, in whole or in part, at any time by providing notice to Members (which may be provided via email, at Participating Locations, on the Program Website, and/or through other communications to Members) between the 90th and the 60th day prior to the cancellation of the Program, outlining the cancellation date and redemption options. You will have 45 days to redeem any Points in your Account if the Program is cancelled after the effective termination date. Any Points that have not been redeemed after the 45-day window has passed will be lost. Where authorized by law, we also reserve the right to decide at any time when Points will stop being usable and expire.

9. Modifications to the Program

In addition to the terms expressly mentioned elsewhere in these terms, the Administrator may unilaterally change the following aspects of these terms at its sole discretion: (a) the methods for participating in the Program, (b) restrictions on eligible purchases and redemptions, (c) the value of Points for collection and/or redemption purposes, (d) how the Program is provided to you and the businesses offering offers in connection with the Program. A written notification containing the new clause, or both the old clause and the revised clause, as well as the date the modification takes effect must be sent to Members between the 90th and 60th day prior to the amendment taking effect, as required by law.

10. General

For whatever reason, including if you don’t fulfill the eligibility conditions or have had a membership cancelled in the past, we reserve the right to refuse to let you join the Program.

The physical Program Card is not a credit card and is optional for participation in The Program. The Card is the Administrator’s property, and in the event that a Member violates these Terms, abuses the Program, commits fraud, or takes any other actions that the Administrator, in its sole discretion, deems to be against the interests of the Program or its Members, the Administrator may, at any time, revoke the Card. Any unauthorized copying of a Card is forbidden and could lead to legal action, the loss of all Points, and termination from the Program.

Members must keep their Account number and other account details private. Your Account, your PharmaChoice ID and any associated Cards on your Account, as well as any passwords or security questions used in conjunction with your Account and Cards, are your responsibility to safeguard and maintain secure.

You must notify us right away if any of the details you provided when you registered for the Program or started taking part in it (such as your email address or postal code) changes by updating your profile information on the Program Website or by getting in touch with our customer support team (see Section 10 for more information). If the information you submitted to us is incorrect or out of date, we will not be responsible for misdirected email or mail messages, including any notices under these Terms or any repercussions thereof. We may get in touch with you to verify our records if we suspect that some of them are wrong. We have the right to close any Account for which we have insufficient or erroneous information, and any awarded Points as well as all Point redemptions on such Account may be forfeited. All collected Points on an Account will be lost if fraudulent or fictitious information is submitted.

Except as otherwise provided herein, these Terms constitute the entire agreement between the Member and the Administrator with respect to the Program and supersede all prior oral or written agreements, understandings, agreements, negotiations, and discussions. Except as expressly stated in these Terms, there are no representations, warranties, covenants, conditions, or other agreements between a Member and the Administrator in connection with the Program, whether express, implied, collateral, statutory, or otherwise, including implied warranties or conditions of merchantability or fitness for a particular purpose. ANY PART OF THESE TERMS MAY NOT BE MODIFIED OR DELETED BY YOU, AND ANY SUCH MODIFICATION OR DELETION WILL BE NULL AND VOID.

Any tax ramifications or other charges imposed by or on behalf of any government that may result from Program participation are not the Administrator’s responsibility or liability in any way.

In the event of a material error, omission, technical issue, computer virus or bug, tampering, unauthorized intervention, fraud, technical failure, or any other circumstance beyond our reasonable control that interferes with the proper conduct of any aspect of the Program as specified in these Terms, we reserve the right to withdraw, temporarily change, or suspend all or part of the Program in any way. Any deliberate attempt to harm any website or to interfere with the proper operation of the Program in any way (as we may determine in our sole discretion) may be illegal and we reserve the right to pursue all available legal remedies and damages if such an attempt is made.

We hold the right to engage in any type of corporate, restructuring, or financing transaction, as well as to sell or transfer all or a portion of the Program to a related company or a third party. The way the Program is delivered to you and the businesses making offers in connection with the Program may also vary. Please see the Program Website’s Privacy Policy for more information on how your personal information will be used in such circumstances.

Any delay in exercising any of our rights, powers, or legal remedies under these Terms or at law does not amount to a waiver of those rights, powers, or legal remedies. The exercise of a right, power, or remedy once or in part does not preclude further use of that right, power, or remedy or the use of any other right, power, or remedy.

The word “including” implies “including but not limited to,” and words in the singular form shall be construed to include words in the plural and vice versa, unless the context otherwise dictates. Any dollar values mentioned in relation to the Program or these Terms are expressed in Canadian currency.

Every clause in these terms is separate and severable, and if any clause or portion of a clause is found to be invalid or unenforceable by a court with appropriate jurisdiction, it will not impact the validity or enforceability of any other clause in these terms.

Consumers residing in the rest of Canada should note that these Terms are governed by the laws of the province of Nova Scotia and the federal laws of Canada applicable therein, without reference to conflict of laws provisions.
